General Terms and Conditions

1. Provision of Services
Putzfrauen-Rapid AG shall carry out the agreed cleaning services in accordance with the service specification. Service times shall be agreed jointly with the client. No cleaning services are provided on public holidays. Hazardous work and the moving of heavy objects are excluded. In cases of force majeure, services may be postponed or suspended.

2. Personnel and Requirements
Putzfrauen-Rapid AG shall assign suitable personnel and, where possible, arrange a replacement in the event of holidays or illness. The client has no right to request a specific employee. The client shall ensure access to the premises, provide suitable cleaning products and fully functional equipment, as well as water and electricity. The client shall ensure safe working conditions, secure valuables and confidential documents, and ensure that pets do not interfere with or endanger the service personnel during the assignment. Alcohol consumption and smoking are prohibited for personnel during working hours.

3. Data Protection and Confidentiality
Putzfrauen-Rapid AG processes customer data in accordance with applicable data protection laws and its privacy policy. Employees shall treat all information obtained in the client’s household as confidential. Photo or audio recordings of employees are only permitted with their explicit consent.

4. Complaints
Any obvious complaints must be submitted to the office in writing and with reasons within 48 hours after the cleaning service has been performed. Otherwise, the service shall be deemed to have been provided in accordance with the contract in this respect. Putzfrauen-Rapid AG shall be given the opportunity to remedy any deficiencies.

5. Cancellations and Absences
Cancellations or postponements must be communicated to the office at least 48 hours in advance. Otherwise, or if access to the premises is not possible, the service appointment will be charged in full unless the client can prove that a lower loss has occurred.

6. Price Adjustments
In the event of changes to the order, collective employment agreement requirements, wages and related wage costs, statutory charges, value-added tax, or inflation, Putzfrauen-Rapid AG may adjust prices appropriately. Any price adjustments shall be announced in writing at least 30 days in advance.

7. Contract Term and Notice Period
The contractual relationship may be terminated by either party during the first year of the contract with one month’s notice and thereafter with three months’ notice, in writing, effective at the end of a calendar month. Mandatory statutory rights of termination remain unaffected. In the event of termination at an inappropriate time, the right to claim compensation for any resulting damage remains reserved.

8. Payment Terms
Invoices shall be issued by the 3rd day of the following month. Invoices are payable within 20 days. In the event of late payment, reminder fees of CHF 10.– for the first reminder and CHF 30.– for the second reminder shall apply. Further services may be suspended until full payment has been received.

9. Liability and Insurance
Putzfrauen-Rapid AG maintains liability insurance coverage of up to CHF 5 million and shall be liable for proven damages caused by its employees. Excluded are pre-existing damage, normal wear and tear, and sensitive surfaces that were neither identifiable nor reported in advance. Damages must be reported in writing within seven days of discovery; later notifications are only accepted if an investigation is still possible.

10. Non-Solicitation / Prohibition of Direct Employment
The client shall not employ employees of Putzfrauen-Rapid AG, either directly or indirectly, during the contractual relationship or for twelve months thereafter. In the event of a breach, a contractual penalty equal to the amount invoiced for services during the last three months shall be payable. Further claims for damages remain reserved.

11. Amendments to the Contract
Any amendments or additions to the contract must be made in writing. Communications by email shall be deemed to satisfy the written form requirement. Price adjustments pursuant to Section 6 remain reserved.

12. Communication
All organisational arrangements, in particular changes to appointments and additional orders, must be agreed with the office. Direct arrangements with employees shall only become binding once confirmed by the office.

13. Applicable Law and Place of Jurisdiction
Swiss law shall apply exclusively. The place of jurisdiction shall be Zurich, subject to mandatory statutory places of jurisdiction.
